Terms of service
Last updated: 27 October 2026
These terms apply when an organisation uses SimDart, the onboarding service operated by DAWNFORGE STUDIOS LTD (“we”). By creating an organisation, or by using the service on an organisation’s behalf, you accept them for that organisation.
1. The service
SimDart lets organisations build onboarding programmes from lessons, knowledge checks and simulations, enrol their people and follow their progress. We provide it as an online service to businesses and other organisations, not to consumers. Features change as we improve it; we will not remove a core function you rely on without telling you in advance.
2. Accounts and organisations
Each person has their own account and keeps their password to themselves. Whoever creates an organisation is its owner and decides who joins it and with which role. Your organisation is responsible for what happens in it, including what its members upload.
3. Trial and plans
A new organisation can use the service free of charge for seven days, without AI features. When the trial ends the organisation stays readable and can be exported; making changes needs a paid plan.
The plans, their prices per month and what each includes are shown on the pricing page. Until online payment is available, we set up the plan you choose with you directly and agree how you pay.
Prices include VAT where it applies. Plans are paid monthly in advance and renew each month until cancelled. You can cancel at any time: the plan stays active until the end of the month already paid for and is not charged again. Payments are not refunded, in full or in part, unless we charged you by mistake or the law requires it.
4. Your content and data
Everything your organisation puts into SimDart, such as programmes, simulations and files, and the records of its members’ learning belong to your organisation. You allow us to store and process them only to provide the service to you. You can export them at any time; deleting the organisation deletes them.
5. Acceptable use
You and your members must not:
- put in content that is unlawful or that you have no right to use;
- try to reach another organisation’s data, our systems or other networks, including from a lab;
- use labs for mining, scanning, sending e-mail or attacking anyone;
- resell access to the service without our written agreement;
- disrupt the service, or test its security without our written agreement.
We may stop a lab, or suspend an account or organisation, that breaks these rules, and we will tell you why.
6. AI features
On plans that include them, AI features draft knowledge-check questions and write coaching notes after client cases. AI output can be wrong: drafts reach learners only after someone in your organisation approves them. SimDart makes no decisions about employment. Scores come from fixed rules, and any decision about a person’s role is your organisation’s. An organisation can switch AI features off at any time.
7. Personal data
For the personal data your organisation puts into SimDart, including its members’ learning records, your organisation is the controller and we process the data on its behalf, as described in the privacy policy. A data processing agreement is available on request. For accounts, this website and the contact form, we are the controller.
8. Availability and support
We aim to keep the service available at all times but cannot promise it will never be interrupted. We back up data every night. Support is available through the contact form or by e-mail.
9. Liability
We provide the service with reasonable skill and care. As far as the law allows, our total liability for all claims in any year is limited to the amount your organisation paid us in the twelve months before the claim, and we are not liable for indirect loss, such as lost profit, or for data you could have exported. Nothing in these terms limits liability that the law does not allow to be limited.
10. Ending
You can stop at any time by cancelling your plan (section 3) or by deleting your organisation. We may end the service for an organisation that seriously or repeatedly breaks these terms, or with 60 days’ notice if we stop offering the service; you can export your data before it ends.
11. Changes to these terms
We may update these terms. We will announce material changes in the product at least 30 days before they take effect.
12. Law
These terms are governed by the law of the country in which DAWNFORGE STUDIOS LTD is registered, and its courts have jurisdiction, unless mandatory law provides otherwise.
